GENERAL TERMS & CONDITIONS

These terms and agreements are valid for all EdOdyssey LLC programs. Programs are run by EdOdyssey LLC hereafter referred to as “EdOdyssey.” 

All references herein to “EdOdyssey” apply to its officers, directors, staff members (employees and contractors), chaperones, group leaders, teachers, agents, and affiliated companies. Participant and EdOdyssey are independent entities and nothing in this agreement is intended or shall be construed to create an agency relationship, employment relationship, or joint venture between the parties.

By enrolling in an EdOdyssey and its affiliated programs individual participants (or parent or guardian if participant is under 18), institutions, and/or groups (any of which are hereinafter referred to as Participant) agree to the following Terms and Conditions:

 

1. General Terms of EdOdyssey Program

(a) The term of the EdOdyssey Program is outlined in the Program Proposal and Program Itinerary. In the event your program includes airfare reservations, all efforts will be made to book airfare for the requested dates. However, until airfare is booked, departure and return date are subject to change +/- three (3) days. EdOdyssey has the right to make changes in program itinerary and departure dates and to modify transportation arrangements, including the use of substitute airlines. In the event of changes being made, refunds will be given only in accordance with the provisions of EdOdyssey’s “Terms and Conditions” supplied herewith.

(b) Participant should exercise proper conduct and behavior in keeping with the rules and policies of their school or institution (if applicable) during his/her period of stay and those of EdOdyssey.

(c) Participant should respect the rules and laws of the country or countries to be visited. Illegal activities will not be tolerated and are punishable by immediate dismissal from the program. If Participant is dismissed from the program the return costs is the responsibility of Participant. If local authorities are involved, Participant is subject to the laws of the country visited.

(d) EdOdyssey reserves the right to reject Participant or dismiss Participant from the Program at their sole discretion.

(e) The consumption of alcohol is strictly forbidden by students for all primary and secondary programs, even if Participant is of age in the country to be visited. The use of alcohol may result in immediate dismissal from the EdOdyssey program and if the participant is sent home it is at his/her own expense without escort and without refund for missed portions of the program. Should the local authorities be involved the participant understands that he/she is subject to local law.

(f) The use of illicit drugs is strictly forbidden for all programs. The use of drugs may result in immediate dismissal from the EdOdyssey program. If the participant is sent home it is at his/her own expense without escort and without refund for missed portions of the program. Should the local authorities be involved the participant understands that he/she is subject to local law.

(g) Participant must obtain a passport and any applicable visa(s) for his or her program prior to departure. If a Participant is unable to obtain these travel documents, our standard Cancellation Policy will apply. Please ensure that passports are valid for at least six (6) months after the program end date. Non-U.S. citizens need to contact the embassy or consulate of the destination country to ensure they meet entry requirements. Remember to check your itinerary carefully for all countries that will be visited or pass through, including transfers between airports in foreign countries and re-entry into the United States of America.

(h) EdOdyssey is not responsible for airline schedule changes, or mechanical, weather, or capacity-related flight delays.

(i) Students and chaperones will be roomed in high quality housing accommodations. In general, up to three (3) students per room and one (1) faculty per room. This may vary from program to program. The exact details will always be outlined in the Program Itinerary.

2. Program Fee

(a) The Program Fee covers everything listed in the Program Itinerary. Typically this includes, unless otherwise noted: all activities and site visits listed in the program itinerary, full-time EdOdyssey program leader, 24-hour assistance from EdOdyssey’s international and local teams, parent/student Pre-Departure Meeting, emergency medical insurance (see policy for complete details), meals (as noted in the program itinerary), all domestic group transportation, all tips for drivers, local guides, restaurant attendants., high quality housing accommodations, personalized webpage for students, families, and faculty leaders and program updates during the trip.

(b) The Program Fee does not cover: passport, visa, and other fees, expenses caused by airline rescheduling, cancellations, or delays caused by the airlines, bad weather, or other event(s) beyond EdOdyssey’s control and outside EdOdyssey’s insurance coverage, personal spending money, applicable baggage fees, personal spending money, or other expenses that do not fall under the scope of the EdOdyssey Program Fee.

(c) The Program Fee schedule can be found on the program’s webpage.

 

3. Compliance with Laws, Rules and Regulations, and Standards of Conduct

(a) Participant shall comply with EdOdyssey’s Rules and Regulations while enrolled in the Program for the duration of the duration of the program

(b) Participant shall observe and obey the laws and regulations of the country or countries to be visited and respect the social norms and customs.

(c) EdOdyssey and/or the host institute shall have the right to enforce appropriate standards of conduct and may at any time terminate Participant’s participation in the Program for failure to maintain these standards or for any actions or conduct which EdOdyssey’s and/or the host institute considers to be incompatible with the interest, harmony, comfort and/or welfare of other students, staff, and/or the laws and regulations of the country or countries to be visited during the Program.

(d) EdOdyssey maintains, among several explicit and implicit Standards of Conduct policies, a strict zero-tolerance policy regarding the use and/or possession of illegal substances. Use and/or possession of illegal substances may result in expulsion from the Program, without refund, as well as possible criminal prosecution in the host country.

 

4. Medical and Health

 (a) All program participants are required to have health insurance. Participant may be required to show proof of health insurance during registration procedures. All participants will also receive emergency travel and health insurance purchased by EdOdyssey. Participants are welcome to purchase additional/supplement insurance if they wish.

(b) It is the responsibility of Participant to thoroughly review health and safety information from both the CDC and the U.S. State Department in advance of Participant’s departure, and to take any safety or health precautions Participant deems necessary prior to or during Program based on this information.

(c) EdOdyssey is not responsible for any medical or health problems, sickness, disease, injury, or loss whatsoever suffered by Participant during any period of the Program, during independent travel, and/or during any activities, whether or not sponsored, facilitated, or hosted by EdOdyssey. 

(d) Participant hereby grants EdOdyssey and its agents full authority to take whatever actions they may consider to be warranted in the event of any personal emergency, international or political unrest, or other event regarding the health and safety of Participant, and Participant fully releases EdOdyssey and its agents from any liability for such decisions or actions as may be taken in connection therewith. 

(e) If Participant becomes ill or incapacitated during the Program, EdOdyssey and its employees may take any action they deem necessary for the safety and well-being of Participant, including securing medical treatment (at Participant’s own expense) and transporting Participant home (at Participant’s own expense). Participant agrees to indemnify EdOdyssey for any expense, fee, loss, damages, etc., in taking any action EdOdyssey deems necessary under this clause.

(f) In the event of a medical emergency, or as deemed necessary by EdOdyssey, Participant authorizes EdOdyssey and its agents at their discretion to place Participant (at Participant’s own expense and without Participant’s further consent) in a hospital for medical services and treatment, or if no hospital is readily available, to place Participant in an alternative facility to be treated by a medical doctor.

(g) If the participant has a food allergy, he/she will take complete charge of their food intake during the program. He/she understands that language differences may impede understanding of certain ingredients contained in various recipes. He/she understands that EdOdyssey will not be liable for any incident that arises as a result of my allergy. He/she also understands that they will not be compensated for any uneaten meals.

 

5. Cancellation Policy 

(a)  All cancellations and requests for refund must be made in writing to EdOdyssey. Requests must be received within the timeframes listed below. Request should be mailed to: cancellations@edodyssey.com

Standard Cancellation Policy:

a.     90 days or more prior to departure: FULL REFUND LESS NON-REFUNDABLE PROGRAM DEPOSIT AND ANY UNRECOVERABLE COSTS (E.G. INTERNATIONAL AIRFARE).

b.     89 days to 61 days before departure: FULL REFUND LESS NON-REFUNDABLE PROGRAM DEPOSIT AND ANY UNRECOVERABLE COSTS (E.G. INTERNATIONAL AIRFARE)., PLUS A $300 CANCELLATION FEE.

c.     60 days or less before departure: NO REFUND CAN BE GIVEN.

 Chaperone Cancellation:

In the event a faculty chaperone(s) leading the program and cancels, EdOdyssey will ask that he/she find a new chaperone to replace him/her. EdOdyssey is not responsible for any increase in his/her airline costs. If a chaperone cannot be found EdOdyssey’s Standard Cancellation Policy applies for students.

 

6. Use of Photos, Videos, and Statements

 (a) EdOdyssey reserves the right to use any photos or videos of Participant, or statements made by Participant, for print, verbal, Internet, or other commercial use and shall not be held liable for such use.

(b) Requests to decline such use must be sent in writing to EdOdyssey at info@edodyssey.com.


7. Waiver 

(a) Participant agrees to waive and release EdOdyssey LLC (which term shall include officers, shareholders, directors, the company itself, employees and agents of the company, and any person or entity employed or utilized by EdOdyssey) and agrees not to sue such persons for any claims which may arise from, or in connection with, any physical or property damage which Participant may suffer from any cause whatsoever. Without limiting the generality of the foregoing, Participant releases such persons for any physical or property damage which Participant may suffer resulting from natural disasters, strikes or government restrictions, war, terrorist activities, sickness or quarantine or the acts or omission of any other agents over which such persons have no direct control, including, without limitation, airlines, transportation companies and railways, bus companies, taxi services, restaurants, student residences, apartments, youth hostels and/or hotels.

(b) Participant shall be responsible for taking all measures and exercising caution and common sense at all times to avoid injuries and/or death.

(c) Participant hereby waives and releases all claims against EdOdyssey and its agents arising at any time during the Program (whether Participant is or is not under the direct supervision of EdOdyssey and/or its agents), and Participant agrees to indemnify EdOdyssey and its agents against any consequences thereof.

(d) EdOdyssey shall not be liable for any loss, harm, injury, or damages sustained by Participant or caused to Participant’s property howsoever caused.

 

8. Legal Governance 

(a) This agreement shall become effective when the Participant’s Application Form and/or Application is accepted by EdOdyssey, and shall be construed and enforced in accordance with, and the rights of the parties shall be governed by, the laws of the Commonwealth of Massachusetts applicable thereto.

 

9. Modifications 

(a) This agreement is standard and cannot be modified or interpreted except in writing and no verbal modification or interpretation shall have any validity. Any other term and/or condition not mentioned in this agreement or Program proposal/itinerary is outside the scope of this agreement.


10. Release 

(a) By enrolling in an EdOdyssey Program, the Participant understands and agrees to the release EdOdyssey (which term shall include agents, officers, directors, shareholders, staff members, employees, contractors, as well as EdOdyssey itself), the Participant’s school board/district, college or university, and the Participant’s school and teacher(s)/faculty/Group Leader(s) from, and agree not to sue such persons for, any claims that may have arising from, or in connection with, any physical or property damage or other loss that Participant may suffer from any cause whatsoever other than the gross negligence of such persons. Without limiting the generality of the foregoing, Participant releases such persons from, and agree not to sue such persons for, any damages that they may suffer from any injury, loss, damage, accident, delay, or expense resulting from events beyond their control, including, without limitation, acts of God, weather, war, strikes, incidents of politically motivated violence, sickness or quarantine, government restrictions or regulations, and, in the absence of gross negligence, arising from any vehicle, or from any act or omission by bus or car rental agency, steamship, airline, railroad, taxi or tour service, hotel, restaurant, school, university, or any other firm, agency, company, or individual.

11. Program Agreement

(a) By enrolling in an EdOdyssey Program, the Participant understands and agrees to the following:

Custom Program, Faculty Led, Secondary, & Other Programs

EdOdyssey LLC, hereinafter referred to as “EdOdyssey”, offers custom programs around the world, hereinafter referred to as “Program”. Programs include immersions, faculty-led, exchanges and other custom odysseys for primary, secondary and undergraduate students, hereinafter referred to as “Participant”,

By enrolling and participating in this program, I, the Participant (or parent or guardian if Participant is under 18), institutions, and/or groups,understand and agree to the following:

  1. I understand the EdOdyssey’s Program begins with the arrival to the destination country and ends upon departure from the destination country.

  2. I understand that the air carriers’ liability for loss or damage to baggage or property, or for death or injury to person, is limited by their tariffs and/or the Warsaw Convention and related agreements. Further, I understand that the air carriers assume no responsibility to any traveler aside from their liability as common carriers.

  3. I understand that EdOdyssey is not responsible for me when I am apart from EdOdyssey-supervised activities, such as visits to friends or relatives or periods that do not include the services of an EdOdyssey staff member.

  4. If I become ill or incapacitated, EdOdyssey and its employees, or teacher(s)/faculty/Group Leader(s), may take any action they deem necessary for my safety and well-being, including securing medical treatment (at my own expense) and transporting me, the Particpant, home.

  5. I agree to abide by EdOdyssey’s regulations and the directions of the teacher(s)/faculty/Group Leader(s) and EdOdyssey’s personnel during the program. Failure to do so may result in EdOdyssey terminating me from the program immediately. I understand that to disobey such rules or directions is to waive the right to a refund of any part of the Program Fee and that EdOdyssey may then send me home at my own expense and without an escort.

  6. I agree to abide by all local laws when abroad, including those concerning drugs and alcohol. I understand that to abuse or disobey such laws is to waive the right to a refund of any part of the Program Fee and that EdOdyssey may then send me home at Participant's own expense. I also understand the consumption of alcohol is strictly forbidden for students participating in any primary or secondary school programs even if the I, the Participant, is of age in the country to be visited. The use of drugs or alcohol may result in immediate dismissal from the EdOdyssey program. If I, the Participant, is dismissed from the program I am responsible for return costs. I also understand that should local authorities be involved, I will be subject to the laws of the country I am visiting and EdOdyssey may be unable to assist.

  7. I understand that I will be required to pay for any phone calls or incidental personal expenses that I incur at hotels, as well as for any damage I cause to hotel rooms, buses, ferries, trains, or cruise ships. I will indemnify EdOdyssey and hold it harmless for any financial liability or obligation which I personally incur, or injury or damage to the person or property of others which I cause or contribute to, while participating on an EdOdyssey program.

  8. I understand that both EdOdyssey and the teacher(s)/faculty/Group Leader(s) reserve the right to refuse or cancel my enrollment at their sole discretion and that standard cancellation fees will apply.

  9. EdOdyssey has the right to make changes and modify the program itinerary including but not limited to departure dates, return dates, and transportation arrangements, including the use of substitute airlines. In the event of changes being made, refunds will be given only in accordance with the provisions of EdOdyssey’s General Terms and Conditions.

  10. I understand that it is my responsibility to secure the necessary travel documents, including a passport, visas, transit visa, and any required travel insurance unless specifically arranged for the group by EdOdyssey. Failure to do so does not constitute grounds for a refund except according to the normal cancellation guidelines as outlined in EdOdyssey’s General Terms and Conditions.

  11. I acknowledge my choice to travel with the teacher(s)/faculty/Group Leader(s) organizing my group, and I understand that this choice is not the responsibility of EdOdyssey. I understand that EdOdyssey reserves the right to reassign the teacher(s)/faculty/Group Leader(s) should my original teacher(s)/faculty/Group Leader(s) be unable to, or determine not to, participate in the program and that the standard cancellation policy will apply if I choose not to travel.

  12. I understand that future EdOdyssey advertising and publicity material may include statements made by participants or their video clips or photographs, and I consent to such use of my comments or photographic likenesses.

  13. I understand that as a participant over the age of 18, or as a parent of a participant under the age of 18, my personal details (or my child’s personal details) will be shared with EdOdyssey staff, partners, and contractors in order to secure bookings and reservations. I also authorize and understand that my first and last name (or my child’s first and last name) will be included in an online roster, which is visible to other program participants.

  14. This agreement constitutes the entire agreement between EdOdyssey and me with reference to the subject matter referred to herein, and I understand that no warranty or representation not herein, including but not limited to any oral statements made to me by agents of EdOdyssey or by my school or teacher(s)/faculty/Group Leader(s), applies to any EdOdyssey program. This agreement may be amended or modified only in writing, duly signed by an EdOdyssey representative.

  15. This agreement shall become effective when the Participant’s Application Form and/or Student Information Form is accepted by EdOdyssey, and shall be construed and enforced in accordance with, and the rights of the parties shall be governed by the laws of the Commonwealth of Massachusetts applicable thereto.

Study Abroad Programs

EdOdyssey LLC, hereinafter referred to as “EdOdyssey”, offers a Study Abroad program in Peru, hereinafter referred to as the “Program” to undergraduate students, hereinafter referred to as “Student” or “Participant”. Study Abroad includes EdOdyssey’s Summer Term, one (1) semester program, and full year or two (2) semesters program in Lima, Peru.

By enrolling and participating in the program I, the Participant / Student (or parent or guardian if Participant is under 18), understand and agree to the following Release & Agreement:

  1. The Program Start Date is defined as the first day of EdOdyssey orientation. The Program End Date is the last day of scheduled activities. Both the Program Start Date and Program End Date will be published on the program webpage.

  2. I understand the Program begins with the arrival to the destination country and ends upon departure from the destination country.

  3. I understand that the air carriers’ liability for loss or damage to baggage or property, or for death or injury to person, is limited by their tariffs and/or the Warsaw Convention and related agreements. Further, I understand that the air carriers assume no responsibility to any traveler aside from their liability as common carriers.

  4. EdOdyssey will arrange for collection of Students at the Lima airport on the designated days of arrival. Students whose flights are delayed or changed by the airline and/or any Students choosing to arrive on a different day will be responsible for their own transportation from the airport to their host families. At the conclusion of the semester, EdOdyssey will also arrange for student drop-off at the airport on the designated days of departure. Students whose flights are delayed or changed by the airline and/or any Students choosing to depart outside of the departure window will be responsible for their own transportation to the airport. The arrival and departure time frames will be announced in advance of the Program Start Date.

  5. If I become ill or incapacitated, EdOdyssey and its employees may take any action they deem necessary for my safety and well-being, including securing medical treatment (at my own expense) and transporting me home.

  6. I agree to abide by EdOdyssey’s regulations detailed in the Student Handbook and the directions of EdOdyssey’s staff during my program. Further, I agree to abide by EdOdyssey’s regulations and the directions ofEdOdyssey’s personnel during the program. Failure to do so may result in EdOdyssey terminating me from the program immediately. I understand that to disobey such rules or directions is to waive the right to a refund of any part of the Program Fee and that EdOdyssey may then send me home at my own expense and without an escort.

  7. I agree to abide by all local laws when abroad, including those concerning drugs and alcohol. I understand that to abuse or disobey such laws may result in dismissal from the Program. I also understand the consumption of alcohol and drugs is strongly discouraged as it impacts Students ability to make prudent decisions. If I chose to use drugs or alcohol I also understand that should local authorities be involved, I will be subject to the laws of the country I am visiting and EdOdyssey will be unable to assist.

  8. I understand that it is my responsibility to secure the necessary travel documents, including passport, visas, transit visa and any required travel insurance. Failure to do so does not constitute grounds for a refund except according to the normal cancellation guidelines as outlined in EdOdyssey’s General Terms and Conditions.

  9. I understand that both EdOdyssey reserves the right to refuse or cancel my enrollment at their sole discretion and that standard cancellation fees will apply.

  10. I understand that it is my responsibility to secure any necessary vaccinations before arrival in Peru. I also understand it to thoroughly review health and safety information from both the CDC and the U.S. State Department in advance of Student’s departure, and to take any safety or health precautions Student deems necessary prior to or during Program based on this information.

  11. I agree to advise EdOdyssey in writing at least forty-five (45) days prior to the Program Start Date of any allergies and/or medical conditions.

  12. I understand that EdOdyssey is not responsible for any medical or health problems, sickness, disease, injury, or loss whatsoever suffered by Student during any period of the Program, during independent travel, and/or during any activities, whether or not sponsored, facilitated, or hosted by EdOdyssey.

  13. I understand that future EdOdyssey advertising and publicity material may include statements made by Participant or their video clips or photographs, and I consent to such use of my comments or photographic likenesses.

  14. EdOdyssey has the right to make changes and modify the program itinerary including but not limited to departure dates, return dates, and transportation arrangements, including the use of substitute airlines. In the event of changes being made, refunds will be given only in accordance with the provisions of EdOdyssey’s General Terms and Conditions.

  15. I understand that as a participant over the age of 18, or as a parent of a participant under the age of 18, my personal details (or my child’s personal details) will be shared with EdOdyssey staff, partners, and contractors in order to secure bookings and reservations.

  16. This agreement shall become effective when the Student Application Form is accepted by EdOdyssey, and shall be construed and enforced in accordance with, and the rights of the parties shall be governed by the laws of the Commonwealth of Massachusetts applicable thereto.
